The Davey Tree Expert Company (“Davey Tree,” "us," "we," or "our") offers and maintains the website(s) located at  www.wolftreeinc.com, including all subdomains and subparts, and our My Davey Portal (collectively, the “Site”) The Davey Tree Expert Company also maintains social media accounts on Facebook, LinkedIn, X, and other platforms (collectively, the “Social Media Pages”). When you visit the Site, call or visit our offices, meet with our representatives, purchase or request our services, or otherwise interact or communicate with us, including on our Social Media Pages, you may choose to provide us with personal data that identifies you. Information is one of the most powerful and valuable assets in business today. The Davey Tree Expert Company is accountable for the personal data in its custody, including any personal data that we transfer to third parties for processing, storage, or other purposes. This Privacy Policy explains how we collect, process, disclose and use your personal data, and it applies regardless of how you access the Site or provide your personal data to us. 2. What Personal Data Do We Collect? 

The amount and type of information that Davey Tree gathers depends on the nature of our interaction with you. In each case, Davey Tree collects information only insofar as is necessary or appropriate to fulfill the purpose of your interaction with us. For example, if you sign up for a Davey Tree account, we ask you to provide a username and email address. If you engage in a transaction with us, we ask you to provide personal and financial information required to process your transaction.  If you engage in a transaction with us through your employer, we also collect information about your affiliation and contact information with your employer.

We may combine information that we receive from the different sources described above; for example, we may create a profile based on Personal Information provided directly from you and input information regarding your interaction history with sales representatives into that profile.

Davey Tree does not collect all of the above types of information in all cases. Davey Tree may also collect information in a de-identified or aggregated format (in a way that does not identify you) and which is not subject to this Policy. Davey Tree will not seek to collect certain types of sensitive or protected Personal Data from you, which includes but is not limited to your racial or ethnic origin, physical or mental health, religious beliefs, biometric information, status as transgender or nonbinary, or status as a victim of a crime.

Mobile Messaging Communications  
With your opt-in consent, we may use your information to send you electronic messaging (e.g., mail, text messaging, etc.) or other wireless device multimedia messaging services (“MMS”) or short message services (“SMS”) communications directly (or through our contracted messing service provider) for both employment application, recruiting, interview scheduling and applicant communication purposes, and other Company business, services, products, and marketing purposes. 

Data and information obtained from you in connection with these communications may include your cell phone number, your wireless carrier's name and the date, time and content of your messages. We may use this information to contact you and to provide employment, recruiting, services or communications you request from us. Messages and data rates may apply for any SMS, MMS, and other electronic communications, depending on carrier and service plan. For example, you may be charged a fee by your wireless carrier to send and receive messages based on the terms of your wireless device service plan. We are not responsible for any fees or charges incurred by you.

Cookies store text and can later be read back by the Site or third parties. Our lawful basis for processing the Personal Information described in this Notice depends on the type of Personal Information and the specific context in which we collect it.

We will normally process your Personal Information from you only (1) where you have provided your consent for us to do so, (2) where we need the Personal Information to perform a contract with you or provide services or goods to you that you have requested, or (3) where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to process your Personal Information.

You are able to revoke your consent given to us for the use of your Personal Information at any time. Please note that even if you revoke your consent, we may continue to use your Personal Information if we have a separate lawful basis for doing so. 

6. How Do We Use Your Personal Data?

  • for legal, safety, or security reasons, such as to comply with legal requirements, to protect the safety, property, and rights of Davey Tree, those who interact with Davey Tree, and others, including in emergency situations, to enforce or apply our terms of use and other agreements, and to detect, prevent, and respond to security incidents or other malicious, deceptive, fraudulent, or illegal activity; 

  • to provide customer service to you, such as a service estimate; and 

  • for any other purpose that is compatible with the foregoing for which we have a legal basis or for which you provide consent. 

In addition, we may share your Personal Data with third-party services and/or advertising networks, including but not limited to Invoca, Google Display Network or Google Analytics, that collect, monitor, and analyze Log Data to deliver online behavioral advertising that serves ads to you on Davey Tree’s behalf on other sites throughout the Internet. Davey Tree has enabled the following Google Analytics features: Google Signals, Granular Location & Device Data Collection, and Advanced Settings for Ads Personalization. When you visit the Site, you will have an opportunity to manage these Google Analytics features in a banner at the bottom of your screen.  You may choose to accept all of the features, opt-out of all of the features, or manage your preferences to some level of usage of the features in between all or none. Note that if you disable, delete, or refuse to accept usage of the Google Analytics features, you may not be able to use some features of the Site and/or some of our pages might not display properly.  

7. What Data Is Not Covered By The Privacy Policy? 

The limitations in and requirements of this Privacy Policy do not apply to:

Third-Party Sites: The Site may contain links to other websites not operated or controlled by us (“Third Party Sites”). DAVEY TREE IS NOT RESPONSIBLE FOR THE POLICIES AND PRACTICES EMPLOYED BY, OR THE CONTENT OF, THIRD-PARTY SITES. We provide such links only as a convenience and the inclusion of a link on the Site does not imply endorsement of the linked site by Davey Tree. If you provide Personal Data through any such Third Party Site, your Personal Data may be collected by the third party and controlled by the privacy policy of that third party. This includes sites hosting Davey Tree’s Social Media Pages; Davey Tree does not control the collection of data through cookies, beacons, or other web tracking technologies on these Third-Party Sites. We suggest contacting those sites directly for information about their privacy policies and practices.

Deidentified Data: Any non-personally identifiable data we collect, including, without limitation, Log Data, domain names of your Internet Service Provider, your approximate geographic location, a record of your usage of the Site, the time of your usage, and aggregated personally identifiable information, but only to the extent the foregoing cannot be used to specifically identify you.

Aggregated Personal Data: Any aggregated Personal Data that can no longer be used to identify you will be treated as non-personally identifiable data under this Privacy Policy. 

Employees/Contractors/Applicants: This Privacy Policy does not apply to Personal Data of employees, contractors, job applicants, or their dependents, of Davey Tree. 

8. How Do We Disclose Your Personal Data? 


While we seek to limit disclosure of your Personal Data, there are certain circumstances in which we may disclose or transfer your Personal Data to certain third parties to perform services on behalf of Davey Tree.

Davey Tree maintains social networking accounts and integrated tools on the Site that help us interact with you through social networking websites, such as Facebook, LinkedIn, YouTube, Instagram, Pinterest, and X. We may also work with application developers who specialize in social commerce so you can connect to us, share your interests, express opinions about products and services, purchase our products and services, and generate interest in our products and services among members of your social networks. Using these integrated tools enables you to disclose your Personal Data to other individuals or the public, depending on the settings that you have established with social networking websites. If you use social networking website features integrated in the Site, we may collect or disclose the information you transfer to us, including your Personal Data.

If you do not want us to be able to access information about you, including Personal Data, from social networking websites, you must limit data collection and disclosure in the privacy settings on the Third Party Sites. We reserve the right to remove the Personal Data or other data of any person for any reason we, in our sole discretion, deem appropriate.

9. How We Secure Your Personal Data
 

Davey Tree has security measures in place to help protect your Personal Data. We secure your Personal Data by: keeping Personal Data up to date; storing and destroying it securely; using industry standards to protect Personal Data from loss, misuse, unauthorized access and disclosure, alteration, and destruction; and ensuring that appropriate technical measures, such as encryption, are in place to protect Personal Data. For example, when we collect credit card data, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the beginning of the address of the Web page.

While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to Personal Data. Our computer servers are kept in a secure environment.

However, no network, server, database, or Internet or e-mail transmission, is ever fully secure or error free. Therefore, you should take special care in deciding what Personal Data you send to us electronically. 


10. How Long Will We Keep Your Personal Data?
 

We will retain your personal data as long as necessary to carry out the function for which you provided it to us, including maintenance of your account. You may close your account, unsubscribe to emails, and otherwise limit our use of your Personal Data by contacting us. However, we may retain your Personal Data for an additional period as is permitted or required under applicable laws. Even if we delete your Personal Data, it may persist on backup or archival media for an additional period of time, until such media is restored to an active system, next accessed, or otherwise used.

You have the right to consent or withdraw your consent to the processing of your Personal Data at any time, subject to exceptions defined by law. To opt-out of receiving emails, direct mail, catalogues, or other communications, please email us at privacy@davey.com with the phrase “Privacy Opt-out” in the subject line and specify what you would like us to do (for example, Change my mailing preferences). To stop email communications from us, you can also follow the unsubscribe instructions set forth at the bottom of our promotional e-mail messages. You may also access and correct some of your Personal Data by logging into your online account, if you have one.

If you choose to limit our use of your Personal Data, you may not have access to certain functionality of the Site. If you change your privacy preferences in the future, that will not limit the lawfulness of any processing performed based on your prior consent. You may have additional rights, under the laws of your jurisdiction, with which we comply.

To exercise any of your rights, you or your authorized agent may call us toll-free at 1-800-445-8733, email us at privacy@davey.com, or complete the web form hosted here.  Before we may fulfill a request to access, correct, or delete your information, we are required to verify your identity.  We will ask you to verify, at a minimum, your name, address, email address, or telephone number.   When providing us this information, you represent and affirm that all information provided is true and accurate. If we are unable to verify that the consumer submitting the request is the same individual about whom we have collected Personal Data, or an authorized agent, we may contact you for more information, or we may not be able to meet your request.  Only you, or an agent legally authorized to act on your behalf, may make a verifiable request related to your Personal Data. If you are making a request as the authorized agent of a consumer, we will ask you also submit reliable proof that you have been authorized in writing by the consumer to act on such consumer's behalf.

We will make every effort to respond to your request within 45 days from when you contacted us. If you have a complex request, we may require up to 90 days to respond. We may contact you within 45 days from the date you contacted us to inform you if we need more time to respond.

Personal Data does not include: publicly available information; de-identified or aggregated consumer information; or information excluded from the scope of state consumer privacy laws, such as health or medical information covered by the Health Information Portability and Accountability Act (HIPAA) or personal information covered by certain sector-specific privacy laws, such as the Fair Credit Reporting Act (FCRA).

13. We Do Not Collect The Personal Data of Children 

We do not intentionally or knowingly collect any Personal Data from children under the age of eighteen (18), nor do we target our emails to them. Children under the age of eighteen (18) should not submit any Personal Data through the Site.
